What exactly is Medical Malpractice?
Medical malpractice is a cause of action that happens when a health care professional moves away from the set standards in his or her profession or discipline, and as a result causes injury or complications to a patient.
For example:
- If a healthcare provider has failed to prescribe the correct medication to a patient or has failed to do a proper assessment of the patient, thus administering medication that causes an allergic reaction in the patient which may lead to severe morbidity such as anaphylactic shock and/or Stephen Johnson syndrome.
- Another example is a lack of proper assessment of a patient and masking pain with analgesics without establishing the source and cause of pain. This could happen when a patient complains of lower right abdominal pain and is given pain killers, only to find that the patient had appendicitis which then ruptured, causing severe morbidity or death.
What should I do if I think I have a Medical Malpractice claim?
Firstly, you would have to show that there was indeed a doctor-patient or healthcare provider-patient relationship that existed. Secondly, you would need to show that the healthcare provider was negligent and how they were negligent. Thirdly, you would need to show that the negligence of the healthcare provider caused the injury or the negative outcome suffered by you.
You must start by asking yourself the question that had it not been for the actions or lack of action of the healthcare provider, would you have suffered the injury or negative outcome that you have now experienced. If the answer is a yes, then you must consult an attorney that specialises in Medical Malpractice for a further and thorough assessment of the alleged negligence that you have suffered and to assess whether this negligence indeed resulted in the injury or negative outcome.
Can you still help me even though I am poor?
We assist claimants on a contingency fee basis with their personal injury claims, this is only done after a full assessment of the claim. However, we may assess any other claims and decide on a case by case basis whether we are able to assist or not.
